Description

Has the value of a patent changed as a result of the internet?

As the internet has become a ubiquitous part of our daily activities, it has become increasingly easier and faster to search anything described in a patent. With the dedicated software available today, it has even become possible to consult patent texts worldwide to solve generic (technical) problems. The consequence of this transparency is that every patent idea described is inexorably added to the global 'prior art' after 18 months.

In practice, this leads to the decision to keep good ideas and inventions secret more often than before, rather than describing them in patents. Not spending time, money and attention on protection, but focusing fully on making the best use of the (temporary) advantage over the competitor is the guiding idea here.
