Tendering according to "Best Value"
Description
"Best Value" is not a procurement procedure, like the multiple negotiated procedure, among others. It is a way of thinking and working, in which, of course, procurement principles such as transparency, objectivity and non-discrimination must be applied. "Best Value" has been and is applied in both public and non-public procedures. But also the competitive dialogue and the negotiation procedure.
This way of tendering requires both the tendering party and the potential contractor to have expertise in procurement law and to have a good understanding of pricing and the technology involved in the work to be carried out.
"Best Value" has both supporters and opponents, but it is a way of realising a work for a reasonable price and good quality.
The widening of the N279-north was put out to public tender by the Province of North Brabant, applying Best Value and six "Project Objectives" ("emvi") .
Six market parties submitted tenders, with the contractor combination "De Vaart vof" being awarded the work following the selection procedure. "De Vaart vof" is a contractor combination consisting of Dura Vermeer, Ploegam and Van den Biggelaar.

3. The Tender Rules for Works 2012 (European public)
4. A pre-announced ceiling price excluding VAT
5. Six technical and quality questions (project objectives) relating to the work, which the potential contractors had to answer per question, on a maximum of one A4 page, during the tendering procedure. These answers had to be enclosed in a separate envelope with the tender.
Fictitious amounts were attached to the elaboration of the project objectives, as is customary with "emvi".
6. The weighting was set 70% quality and 30% price.
