Many of the department members of Business Administration are project managers of technical projects. Responsible for engineering, time, budget, HSE.

Nevertheless, conflicts arise regularly between companies and suppliers over the other's non-performance.
Then the legal department is called in, but they only indicate the chances of winning the conflict; but usually do not resolve it. Possibly theses are hardened.

With the Netherlands Arbitration Institute, we want to give you a little more insight into the procedures you can consider to resolve disputes:
- Mediation is meant to come out of it together;
- Arbitration is really about disputes being settled by arbitrators (the private judge), so then, just as with the ordinary judge, a judgement is passed by a third party and there is no longer any question of 'coming out of it together'.

Ms Ms F.D. von Hombracht-Brinkman is director of the Netherlands Arbitration Institute and will give the presentation.

Questions we have asked in advance are:
- What is the difference in procedure/cost between arbitration and mediation?
- At what point do companies go to arbitration?
- What does the average arbitration cost?
- How many times a year is there an arbitration?
- Where is the average resolution? 50/50 of the amount claimed?
- Does NAI have an interest in arbitration, or is one in favour of helping to prevent arbitration
- In which journal are awards covered?
- Are they closed sessions? Or is there a public bench like court hearings
- What type of cases lend themselves to being dealt with in this cycle?????
- Arbitrators are requested by the board; how do you make sure you are requested?
- How do you verify that arbitrators are independent; c.q. where do you find what their 'relationships' are?
